Critical risk disclosure — read before using
Use of this platform involves interaction with experimental blockchain technology and smart contracts that may contain bugs or vulnerabilities. You may lose some or all funds. AgentYOUr and its operators accept no liability whatsoever for any losses arising from smart contract exploits, hacks, bugs, or blockchain network failures. By using the Service you accept all such risks entirely.
These Terms of Service ("Terms") govern your access to and use of the AgentYOUr marketplace platform ("Service") operated by AgentYOUr ("we", "us"). By accessing or using the Service you agree to be bound by these Terms in their entirety. If you do not agree, do not use the Service.
1. Eligibility and geographic restrictions
You must be at least 18 years of age to use the Service. In jurisdictions where the age of majority exceeds 18, the higher age applies.
Restricted jurisdictions: The Service is not available to users in jurisdictions subject to comprehensive international sanctions, including North Korea, Iran, Cuba, Syria, and occupied territories. You are solely responsible for ensuring your use complies with all local laws.
No financial advice: Nothing on the Service constitutes financial, investment, legal, or tax advice. Cryptocurrency transactions carry substantial risk of loss. You are solely responsible for your decisions.
2. The Service
AgentYOUr is a decentralised marketplace for AI agents, prompt templates, code libraries, automation workflows, and related digital assets ("Listings").
Transactions are facilitated by smart contracts on Base, Ethereum, and TRON. We act solely as a platform intermediary and do not own, create, endorse, audit, or guarantee any Listing or smart contract.
Fees:
— Platform fee: 3% deducted from each sale
— Listing publication fee: $1 USD equivalent at submission
— Gas fees: paid by the transaction initiator to the blockchain network
Fees may be updated with 30 days notice.
3. BLOCKCHAIN AND SMART CONTRACT RISKS — ASSUMPTION OF RISK
THIS SECTION IS CRITICALLY IMPORTANT. BY USING THE SERVICE YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL OF THE FOLLOWING RISKS:
3.1 Smart contract risk: The AgentYOUr smart contracts have not been audited by an independent third party. Smart contracts may contain bugs, vulnerabilities, or logic errors that could be exploited by malicious actors. Such exploits could result in the partial or total loss of all funds held in or transacted through the contracts. YOU ACCEPT THIS RISK ENTIRELY AND WAIVE ANY CLAIM AGAINST AGENTYOUR ARISING FROM SMART CONTRACT VULNERABILITIES OR EXPLOITS.
3.2 Blockchain network risk: Transactions on Base, Ethereum, and TRON are subject to network congestion, forks, validator failures, and other technical issues outside our control. Transactions may fail, be delayed, or be processed at unexpected prices. We are not responsible for any losses arising from these conditions.
3.3 Protocol risk: The underlying blockchain protocols (Base, Ethereum, TRON) are themselves experimental technology. Protocol-level bugs, governance failures, or network attacks could result in loss of funds. We have no control over and accept no liability for the underlying protocols.
3.4 Oracle and price feed risk: Where price feeds or oracles are used to calculate USD-equivalent fees, these may be manipulated or fail. We are not liable for losses arising from oracle failures or manipulation.
3.5 Bridge and cross-chain risk: Bridging assets between networks carries additional risks including bridge exploits, liquidity failures, and extended lock-up periods. We are not responsible for losses incurred during bridging.
3.6 Wallet and key management risk: You are solely responsible for the security of your private keys and wallet. Loss of private keys means permanent loss of access to funds. We cannot recover lost keys or reverse unauthorised transactions. We are not responsible for losses arising from wallet compromise, phishing, or user error.
3.7 Regulatory risk: The regulatory status of cryptocurrencies and blockchain-based platforms is uncertain and varies by jurisdiction. Future regulatory changes could adversely affect the Service or the value of your assets. We are not liable for any losses arising from regulatory changes.
3.8 Market and liquidity risk: Cryptocurrency values are highly volatile. The value of ETH, TRX, USDT, or USDC may change significantly between the time of transaction initiation and confirmation. We are not liable for any losses due to price movements.
3.9 Third-party protocol risk: The Service integrates with third-party protocols including but not limited to wallet providers, RPC nodes, IPFS, and token contracts. Failures, exploits, or changes to these third-party protocols could adversely affect the Service. We are not liable for third-party failures.
3.10 Front-running and MEV risk: Transactions on public blockchains are subject to front-running, sandwich attacks, and other miner/validator extractable value (MEV) strategies. We are not liable for losses arising from MEV.
4. LIMITATION OF LIABILITY — SMART CONTRACT EXPLOITS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
4.1 No liability for exploits: AgentYOUr, its founders, officers, employees, contractors, and agents shall have no liability whatsoever — whether in contract, tort (including negligence), statute, or otherwise — for any losses, damages, or claims arising from:
— Smart contract bugs, vulnerabilities, or exploits
— Unauthorised access to or theft of funds from smart contracts
— Reentrancy attacks, flash loan attacks, or any other DeFi attack vectors
— Oracle manipulation or price feed failures
— Bridge exploits or cross-chain failures
— Any other technical failure of blockchain infrastructure
4.2 No liability for indirect losses: We are not liable under any circumstances for:
— Loss of profits, revenue, or anticipated savings
— Loss of data or digital assets
— Indirect, consequential, special, or punitive damages
— Business interruption losses
4.3 Aggregate liability cap: In jurisdictions where some liability cannot be excluded, our total aggregate liability for all claims is limited to the lesser of: (a) the total platform fees paid by you in the 12 months preceding the claim, or (b) $100 USD.
4.4 Essential basis: You acknowledge that the limitations in this section reflect a reasonable allocation of risk and are an essential basis of the bargain between you and AgentYOUr. Without these limitations, we would not provide the Service.
4.5 Consumer rights: Nothing in this section excludes liability that cannot lawfully be excluded under mandatory consumer protection laws in your jurisdiction.
5. No warranties
THE SERVICE, SMART CONTRACTS, AND ALL LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
— Warranties of merchantability or fitness for a particular purpose
— Warranties that the Service or smart contracts are free from bugs, errors, or vulnerabilities
— Warranties that transactions will be processed successfully or in a timely manner
— Warranties regarding the accuracy, completeness, or quality of any Listing
— Warranties that the Service will be uninterrupted or secure
YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.
6. Indemnification
You agree to fully indemnify, defend, and hold harmless AgentYOUr and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
— Your use of the Service
— Your violation of these Terms
— Your violation of any third party's rights
— Any content or assets you submit to the platform
— Your violation of any applicable law or regulation
— Any transaction you initiate through the smart contracts
This indemnification obligation survives termination of these Terms and your use of the Service.
7. Seller obligations
To list on AgentYOUr, sellers must:
— Complete identity verification and be approved by our team
— Submit only original, legitimate assets they have full rights to sell
— Accurately and completely describe all Listings
— Comply with all applicable laws in their jurisdiction and buyers' jurisdictions
— Pay the listing publication fee
— Not engage in price manipulation, fake reviews, or deceptive practices
— Ensure their assets do not contain malware or harmful code
Sellers are solely responsible for any tax obligations arising from their sales.
8. Prohibited content
Strictly prohibited worldwide — immediate removal and permanent ban:
— Malware, ransomware, spyware, exploits, or offensive security tools
— Content facilitating any illegal activity
— IP-infringing content
— Deepfakes or impersonation tools
— Adult or explicit content
— Content harmful to minors
— Disinformation or deceptive AI systems
— Security circumvention tools
— Sanctions-violating content
— Hate speech or content promoting violence
— Financial market manipulation tools
— Surveillance or stalking tools
Serious violations will be reported to relevant law enforcement authorities.
9. Transactions and payments
All transactions are irreversible once confirmed on the blockchain.
Refund policy: All sales are final. Exceptions may be made at our sole discretion where a seller has materially misrepresented a Listing — contact support@agentyour.ai within 48 hours. No refunds for dissatisfaction with AI output quality.
Supported currencies:
— Base and Ethereum: ETH, USDT (ERC-20), USDC (ERC-20)
— TRON: TRX, USDT (TRC-20), USDC (TRC-20)
Gas fees are non-refundable under all circumstances.
10. Governing law and disputes
EU/UK users: Your statutory consumer rights are not affected. You may bring claims before your local courts and use the EU Online Dispute Resolution platform.
US users: Disputes resolved by binding arbitration under AAA rules, except small claims court eligible claims. Class action waiver applies to the fullest extent permitted by law.
All other users: Disputes subject to jurisdiction mutually agreed, failing which the courts of our registered jurisdiction.

11. Security and audits
Our smart contracts have not yet been independently audited. We plan to commission a professional security audit before processing significant transaction volumes.
We recommend:
— Only transact amounts you can afford to lose entirely
— Use a dedicated wallet for marketplace transactions, not your main wallet
— Verify all contract addresses on Basescan/Etherscan/TRONScan before approving transactions
— Never share your private key or seed phrase with anyone
Official contract addresses are published at agentyour.ai/contracts. Always verify you are interacting with the correct contracts.
12. Changes to Terms
Material changes communicated with 30 days notice via email or platform notification. Continued use after the effective date constitutes acceptance.
